Patent activity of the Institute


Patent activity of the Institute for Fruit Growing is based on legislative and regulatory documentation in the given direction.

In accordance with the Decree of the Council of Ministers of  the Republic of Belarus from April 19, 2006 #531 ‘About making changes and supplements to the Decree of the Cabinet Council of the Republic of Belarus from September 26, 1995 #526’ varieties patenting has become possible on the territory of the Republic of Belarus for the following fruit crops:

Apple tree (Malus domestica Borkh.)

Pear tree (Pyrus communis L.)

Plum tree (Prunus  domestica L.)

Cherry plum tree (Prunus  cerasifera Ehrh.)

Apricote (Prunus  armeniaca L.)

Cherry tree (Prunus  cerasus L.)

Sweet cherry tree (Prunus  avium L.)

Black currant  (Ribes nigrum L.)

Red currant (Ribes sylvestre (Lam) Mert. et W.Koch.)

Strawberry (Fragaria L.)

Raspberry (Rubus L.)

Gooseberry (Ribes uva-crispa L.)

Vine (Vitis L.)

Sea buckthorn  (Hippophae rhamnoides L.)

In 2007 the Institute for Fruit Growing made patent applications for ‘Elena’ apple and ‘Plamennaya’ sea buckthorn varieties; in 2009 - for pear variety 'Prosto Mariya'; in 2010 - for apple clones 'Antonovka Belsad', 'Minskaya Belsad', 'Papirovka Belsad', 'Sinap Belsad', 'Shtrifel Belsad' and for pear clone 'Pozdnyaya Belsad'.

13 varieties of fruit and small fruit crops of the Institute breeding are included into the State Register of copyrighted breeding attainments of the Russian Federation. They are:

Apple tree – Alesya, Pamyat' Syubarovoi, Pamyat' Sikory, Charavnitsa;

Pear tree – Byelorusskaya pozdnyaya;

Plum tree – Vitebskaya pozdnyaya, Kroman';

Cherry plum tree – Mara;

Cherry tree – Zhivitsa;

Sweet cherry tree – Gronkovaya;

Black currant – Kupalinka.

The application was made and positive decision on patent receiving on red currant variety ‘Nenaglyadnaya’ was obtained.

The Institute has negotiated license contracts on cession of rights for 11 patented varieties. On the other hand the Institute acts as a licensee of patent rights in relation to breeding attainments of some other research institutes.
